Hodes Milman filed a medical negligence lawsuit on behalf of plaintiff Vanessa Trinidad Mariscal in the Santa Cruz County Superior Court, against Dominican Hospital and physician Jason Tsukamaki, M.D., Caleb Trent, M.D., and Michael Yen, M.D. The complaint alleges that the healthcare provider failed to properly recognize. communicate, and act on signs of significantly impaired kidney function, delaying diagnosis and treatment of a serious renal condition.
According to the complaint, Mariscal presented to the emergency department at Dominican Hospital on September 8, 2024, with a persistent nosebleed. Laboratory testing allegedly showed markedly abnormal kidney-function values. The lawsuit states that these findings were not properly appreciated, that Mariscal was not informed of their significance, and that appropriate follow-up care and consultations were not arranged.
The complaint further states that on September 16, 2024, Mariscal had a hematology consultation with defendant Dr. Yen, in follow-up to the September 8 emergency department visit. According to the lawsuit, Dr. Yen also failed to appreciate the critical kidney function values from earlier laboratory studies and failed to notify Mariscal or make appropriate and crucial recommendations for follow-up care and treatment.
Hodes Milman contends that, as a direct result of the defendants’ acts and omissions, Mariscal suffered a delay in a diagnosis of sclerosing glomerulonephritis and permanent, severe impairment of her function due to lack of timely treatment. The complaint seeks damages for pain and suffering, medical expenses, lost earnings, loss of earning capacity, costs of suit, and other relief according to proof at the time of trial.
